Terms of Service
Last updated September 24, 2026
FitbyForm is a tool for logging what you do and showing up for people who are counting on you. It is not a doctor, not a coach and not a guarantee. Use it sensibly, and do not be unpleasant to anyone in it: we have zero tolerance for abuse.
The Agreement
When you create an account, the app shows a Before You Start screen with a box to tick that says you agree to these terms and our Privacy Policy, and a separate box for consent to your health data, described in our Consumer Health Data Privacy Policy. Ticking the first box and continuing means you agree to these terms. If you do not agree, do not create an account. FitbyForm, the app and fitbyform.com, is operated by Alex Wtorkowski, sole proprietor, operating FitbyForm (“FitbyForm”, “we”, “us”, “our”), from the United States. These terms are an agreement between you and Alex Wtorkowski, sole proprietor, operating FitbyForm.
A Pre-Release Beta
- FitbyForm is in a pre-release beta. It is unfinished: features will change or disappear, and some things may break.
- The beta is for adults aged 18 and over who live in the United States.
- You can leave whenever you like: in the app, go to Profile, then Settings, then Delete Account.
- Requests, questions and problems go to support@fitbyform.com.
Your Account
- You must be 18 or older.
- Give a real email address. It is how you recover the account.
- Keep your password to yourself. Anything done with your account is your responsibility.
- One account per person.
This Is Not Medical Advice
This matters more here than in most apps, so it is not buried at the bottom.
- FitbyForm is not a medical device. It does not diagnose, treat, cure or prevent any condition, and everything it shows you, including targets, workouts, meal plans and cycle estimates, is general information.
- Calorie and protein targets are an estimate from the Mifflin-St Jeor equation. It is a population average applied to you, not a measurement of you.
- Cycle phases are arithmetic from the dates you enter. They are not contraception, not a fertility indicator, not a diagnosis, and must not be used to plan or avoid pregnancy.
- Meal plans and workout programs are generated by AI models. They are a starting point, and they can be wrong.
- Nutrition figures come from the USDA database and from estimating portions. Treat them as approximate.
Talk to a clinician before changing how you eat or train, particularly if you are pregnant, managing a condition, taking medication, or have any history of disordered eating. Stop if you feel pain, dizziness or shortness of breath, and get help. If food or weight tracking is harmful for you, this app is not the right tool and no streak is worth it. In an emergency, call 911.
What You Post
Your content stays yours. You give us permission to store and display it to the people you have chosen to share it with, which is the only way the app can work.
FitbyForm has zero tolerance for objectionable content and abusive users. Do not post, send or host anything that is:
- someone else’s without their say-so, especially photographs of them;
- harassing, bullying, threatening, or aimed at making a person feel small;
- hateful toward people for who they are;
- sexually explicit, or nudity;
- violent, or encouraging self-harm, extreme restriction, purging, or anything else that hurts people;
- spam, scams, advertising, or illegal.
Public text, such as rally titles and notes, is checked automatically for objectionable language, and text that fails the check is not posted.
Reporting, Blocking and Removal
- Report. Every post, rally and profile has a Report option. Reports are private: the person reported is not told who reported them.
- Block. You can block anyone. Neither of you will see the other’s posts or rallies, and they cannot follow you. You can unblock in Settings.
- Our response. We review every report within 24 hours. Content that breaks these terms is removed, and the account that posted it may be suspended or closed. For anything involving real harm to someone, we act without warning.
- You can also report anything by email to support@fitbyform.com.
Meeting People (Rallies)
Rallies are in-person meet-ups arranged by users, not by FitbyForm. We do not vet hosts or attendees. Meet in public places, tell a friend where you are going, and leave whenever you like. If anything feels wrong, report the rally or the host in the app, and if anyone is in danger, contact your local emergency services first.
Rallies open to everyone are for members 18 and over, both to host and to see. Anyone whose age we do not know can host and join Followers rallies only.
Physical Activity and Meetups: Your Risk
Exercise, challenges, diet changes and meeting people in person all carry real risk, including injury, illness and, rarely, death. You choose what you do, how hard you push, what you eat and whom you meet, and you are responsible for those choices.
- Assumption of risk. To the extent the law allows, you take on the risks of any workout, challenge, meal plan or rally you follow or attend through FitbyForm, whether they are known or unknown, and whether they come from you, the activity, the place, or other people.
- Check you are fit to do it. Stop if something hurts, you feel dizzy, something feels wrong or it is beyond your level, and get medical advice first if you have any doubt.
- Rallies are between the people who go. FitbyForm does not organize, supervise or attend them, does not check who anyone is, and is not responsible for what hosts or attendees do.
- Release. To the extent the law allows, you release Alex Wtorkowski, sole proprietor, operating FitbyForm and its owners, employees and contractors from claims for injury, loss or damage arising from physical activity you do or meetups you attend through FitbyForm, and from the conduct of other users, except where it was caused by our gross negligence or willful misconduct. If you are a California resident, you waive California Civil Code section 1542 for these claims, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
AI Features
Some features send the data needed for them to AI providers named in our privacy policy and our Consumer Health Data Privacy Policy. They only run after you agree in the app, and you can withdraw that agreement at any time.
Connected Services
Connecting Apple Health, Oura or anything else is between you and them as well as us. Their terms apply to their side of it. You can disconnect whenever you like, and we stop syncing and delete any access token we held.
Availability
FitbyForm is a beta, and it is provided as it is. We aim to keep it running and your data intact, and we take both seriously, but we do not promise it will never be down or never lose anything. Keep your own record of anything you would genuinely miss.
We may change or withdraw features. If something you rely on is going away, we will tell you first.
Ending It
Delete your account whenever you want, from Profile, then Settings, then Delete Account, and your data goes with it. See the privacy policy for exactly what that means. We may suspend or close an account that breaks these terms or puts other people at risk.
Liability
To the extent the law allows, we are not liable for indirect or consequential loss arising from your use of FitbyForm, and our total liability is limited to the amount you have paid us for FitbyForm in the twelve months before the claim. Nothing here limits liability for anything that cannot legally be limited.
Changes
If these terms change materially we will email you before it takes effect. Continuing to use FitbyForm after that means you accept the new version.
Law
These terms are governed by the laws of the State of Illinois, United States, without regard to its conflict of law rules.
